Use of the Platform

1.1 Eligibility
‍You must be at least 16 years old to use the Platform. By using the Platform, you represent and warrant that you are at least 16 years of age.

‍To access certain features of the Platform, you may need to create an account. You agree to provide accurate and complete information during the registration process and to keep your account information up to date. You are solely responsible for maintaining the confidentiality of your account credentials and for any activities that occur under your account.

‍1.3 Prohibited Conduct
‍When using the Platform, you agree not to:
- Violate any applicable laws, regulations, or third-party rights.
- Use the Platform for any unauthorized or unlawful purposes.
- Impersonate any person or entity or falsely state or misrepresent your affiliation with any person or entity.
- Engage in any fraudulent, deceptive, or harmful activities.
- Attempt to gain unauthorized access to the Platform or any user accounts.
- Interfere with the proper functioning of the Platform or disrupt the user experience.
- Upload or transmit any viruses, malware, or other malicious code.

Content and Intellectual Property Rights‍

2.1 User-Generated Content
The Platform may allow users to submit or post content, including job applications, job listings, reviews, and comments ("User Content"). By submitting User Content, you grant Waivly a non-exclusive, worldwide, royalty-free, perpetual, irrevocable, and sublicensable right to use, reproduce, modify, adapt, publish, translate, distribute, publicly perform, and display the User Content on or through the Platform.

By submitting a job listing on Waivly Work, you agree to grant Waivly a non-exclusive, worldwide, royalty-free, perpetual, irrevocable, and sublicensable right to obtain and utilize media and information about your company to populate your company page on the Waivly Work platform. This includes but is not limited to logos, descriptions, and any other relevant information necessary to accurately represent your company on the platform.

2.2 Waivly's Intellectual Property
All intellectual property rights in the Platform and its contents, including but not limited to text, graphics, logos, trademarks, and software, are owned by or licensed to Waivly. You agree not to use, copy, reproduce, modify, distribute, or create derivative works based on Waivly's intellectual property without prior written permission.

Additional Services and Products
In addition to job-related services, Waivly Work offers a range of additional services, including but not limited to resume revisions, LinkedIn profile optimizations (with no affiliation to LinkedIn), and CV templates. These services and products are provided to enhance your professional profile and job-seeking experience.

Payment and Processing
Payment for services and products offered through Waivly Work may be required. You agree to pay the applicable fees and charges as stated on the Platform. All payments are processed through a third-party payment processor, Stripe, and your payment information will be subject to their terms and conditions.

User Responsibilities
Users are responsible for maintaining the accuracy of their profiles, complying with applicable laws and regulations, and respecting the rights of other users.

Job Listings and Recruiter Responsibilities
Recruiters are responsible for the accuracy of job postings, compliance with equal opportunity employment laws, and adherence to any other relevant guidelines.

Waivly Newsletter Signup
When signing up to Waivly Work, you have the option to be signed up to the Waivly newsletter at the same time which is a newsletter sent daily on business days where you can get work opportunities as well as the latest tech, business, and finance news sent directly to your email inbox. This newsletter option on the signup page is different to the option to be emailed about promotions in your Work account settings which is intended for promotions solely regarding Waivly Work, its services, and or its memberships. If you are to accept to be signed up to the Waivly newsletter, you may unsubscribe from it at anytime by pressing the 'Unsubscribe' option at the bottom of an email sent from us or by emailing Hello@Waivly.com and requesting to be unsubscribed from the Waivly newsletter.

Termination of Accounts
User accounts may be terminated for violations of the Terms and Conditions, fraudulent activity, or inactive status of 12 or more months. In the event of valid termination of an account by Waivly, any subscriptions will be cancelled. Purchases will not be refunded. You may also delete your account by choice by emailing Hello@Waivly.com or by clicking the 'Delete account' button in your Work account settings and filling out the form on the page you are taken to which will send your account deletion request. We aim to delete accounts that request deletion within 24 hours during business hours.

Privacy
The collection, use, and disclosure of your personal information through the Platform are governed by our Privacy Policy. By using the Platform, you consent to the collection, use, and disclosure of your personal information as described in the Privacy Policy.

Waivly Work Premium

3.1 Subscription and Payments
Waivly Work Premium is a paid subscription service that provides access to premium features. By subscribing to Waivly Work Premium, you agree to pay the applicable fees and charges as stated on the Platform. All payments are processed through a third-party payment processor, and your payment information will be subject to their terms and conditions.

3.2 Cancellation and Refunds
You may cancel your Waivly Work Premium subscription at any time by heading to your account and clicking cancel on the subscription. In the rare event that you can not see this, please email Hello@Waivly.com instead to get your subscription cancelled. No refunds will be provided for any unused portion of the subscription period. Please see our Refund Policy for full details on such.

Limitation of Liability
To the maximum extent permitted by law, Waivly and its affiliates, directors, employees, agents, and representatives shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising out of or in connection with the use of the Platform.

Indemnification
You agree to indemnify and hold harmless Waivly and its affiliates, directors, employees, agents, and representatives from any claims, liabilities, damages, losses, or expenses, including reasonable attorneys' fees, arising out of or in connection with your use of the Platform, your violation of these Terms, or your violation of any rights of any other person or entity.

Modifications to the Platform and Terms
Waivly reserves the right to modify or discontinue the Platform, temporarily or permanently, with or without notice. We may also update or modify these Terms from time to time. Your continued use of the Platform after any modifications to the Terms constitutes your acceptance of such changes.

Governing Law and Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of the United Kingdom. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of the United Kingdom.

Severability
If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect.

Entire Agreement
These Terms constitute the entire agreement between you and Waivly regarding the use of the Platform and supersede any prior agreements or understandings, whether oral or written.

Subscription Payments
If you subscribe to Waivly Work Premium, please be aware that all subscription payments are non-refundable. Once a payment has been made, it cannot be refunded, in part or in full, for any reason, including but not limited to the following:

Unused portion of the subscription period: If you choose to cancel your Waivly Work Premium subscription before the end of the billing cycle, no refunds or credits will be issued for the unused portion of the subscription period.

Dissatisfaction with the service: We strive to provide a high-quality and satisfactory user experience. However, if you are dissatisfied with any aspect of our service, we regret to inform you that we are unable to offer refunds.

Products, Services, and Job Credits
Purchases of products, services, or job credits made through the Waivly Work platform are also non-refundable. Once a purchase has been made, it cannot be refunded, in part or in full, for any reason, including but not limited to dissatisfaction with the product or service.

Exceptions
There may be exceptional circumstances where we may consider providing refunds on a case-by-case basis, at our sole discretion. Such circumstances may include technical issues or errors on our part that prevent you from accessing or utilizing the subscribed features of Waivly Work Premium, or in the case of products, services, or job credits purchased through the platform. However, any such refund consideration will be made solely at our discretion and will not constitute an obligation or precedent for future refunds.

Account Termination or Deletion
If your Waivly Work account is terminated or deleted by choice or due to violations of our Terms of Service, no refunds will be provided for any unused portion of subscriptions, products, services, or job credits.

Refund Request Procedure

Refund Processing Time
Refunds, if approved, will be processed within 60 days from the date of approval. Please note that it may take additional time for the refunded amount to be reflected in your account or statement, depending on your payment provider.

We are not responsible for the content or actions of any user on the platform.  You, the user, are responsible for your interactions with other users. We encourage you to use best practices for online safety when using the Network. By using the Network, you agree to hold harmless and indemnify Waivly Work Network from any and all claims, liabilities, damages, losses, and expenses arising out of or in connection with your use of the Network or your interactions with other users on the Network.

‍These Terms of Service and Privacy Policy shall be governed by and construed in accordance with the laws of England and Wales.

‍Changes to the Terms
‍We may revise these Terms of Service and Privacy Policy at any time. The revised terms will be effective immediately upon posting on the Network.

Earning Commission
As a Waivly Work Affiliate, you can earn a 25% commission on any paying member who signs up for Waivly Work Premium through your unique affiliate link. This includes both individual users and businesses.In addition, you can also earn commission on any products or services purchased through your affiliate link within the Waivly Work platform. This could include career coaching sessions, resume writing services, or other valuable resources offered by Waivly Work or its partners.

Eligibility
There are no social media following requirements to join the Waivly Work Affiliate Program.

Commission Calculations
Commission is only earned on new, paying Waivly Work subscriptions (individual or business) and purchases generated through your unique affiliate link.You earn commission as soon as the first successful payment is made by the referred user.Free trials or non-paying accounts do not qualify for commission.

Payment Schedule and Minimum
Affiliates will be paid on the 15th of each month for the previous month's qualified commissions. You will receive an email notification when your payment is processed. You will be paid out once you reach $5 USD in earnings. If you have not reached $5 in earnings by the payout date but have generated earnings, those earnings will roll into the following month, and that will happen with all earnings until you reach the $5 USD minimum payout requirement. This minimum payout requirement is for the benefit of you as it ensures that you will receive most of your earnings after any applicable fees are deducted for PayPal, the platform in which we will send your earnings through.

Promotional Materials
We encourage you to create promotional materials using our logos and brand assets to promote Waivly Work and the various resources available on the platform. However, you must ensure all materials are used solely for promoting Waivly Work and with our written consent before use.

Promotion Requirements
There are no minimum promotion requirements to remain an active member of the Affiliate Program. However, we encourage you to promote Waivly Work regularly to maximize your earning potential.

Taxes and Legal Responsibilities
You are responsible for all taxes and legal obligations associated with your earnings as a Waivly Work Affiliate. You are acting as an independent contractor and must manage your own accounting and tax responsibilities.

Giveaways
If you choose to host a giveaway featuring a Waivly Work subscription or other platform product/service, you are solely responsible for all aspects of the giveaway, including selecting the winner, purchasing the prize (if applicable), and managing winner data.

Program Termination
We reserve the right to terminate the Waivly Work Affiliate Program at any time. In the event of termination, all outstanding commissions will be paid to affiliates in good standing.

Disassociation from Competitors
You may not be affiliated with any Waivly Work competitor brands or services while participating in the Affiliate Program.

Data Security
We take data security seriously and will take all reasonable precautions to protect your information. However, you are also responsible for maintaining the confidentiality of your affiliate dashboard information.

Content Usage
We reserve the right to use photos and content created by you specifically for the Waivly Work Affiliate Program, such as images of yourself using Waivly Work or promotional materials you create. This usage will be solely for promoting Waivly Work on our social media platforms.

Affiliate Removal
We reserve the right to remove any affiliate from the program at any time and for any reason. You will be notified via email if you are removed from the program. Upon removal, any earned commissions up to the date of termination will be paid according to the standard payment schedule.
